There is no doubt that Intellectual Property is a key element of the way today's business models and technical systems are defined. As one example, the ability to be granted the right to license a competitor's technology (or the other way round) is essential to a competitive market.
So, the way the Intellectual Property system is set-up and its influence on the Standards development is an area of strong debates and off great interest.

Open Source, Standards and Intellectual Property
A significant issue in the interplay of Open Source and Standards is related to the potential collaboration of Standards Setting Organisations(SDOs) and Open Source Software (OSS) communities in the production of 21st century standards.
This has been a topic of interest for SDOs since a few years. This is in particular the case for ETSI where Emmanuel Darmois has been chairing the group in charge of defining a global approach for dealing with Open Source between end 2014 and May 2018.
The big difficulty is to mitigate the protection of Intellectual Property Rights with the expectation from most of the OSS community that Standards could be made available licensing free. More can be found here.
